He remains unconscious the whole night under the exposure to severe cold. The following morning, he is discovered b y some persons doing road work and is rushed to hospital. In the meantime, due to severe exposure to the cold, he contracts pneumonia. In hospital, he is put next to a patient suffering from an infectious and contagious disease and unfortunately, he dies i n $2$ days. A similar c ase was taken to court in $1991$ against Yorkshire Insurance Co$.)$ James$$ family claims the following under his policy;
