Scenario 1:
Suhana is employed as an Assistant Professor with Tech Era a reputed Higher Educational Institution in Oman . In addition to her salary and allowances package OMR 1500 per month the College has also given her a Microsoft Surface Pro as part of her work equipment. She was allowed to keep the Notebook in her possession even outside of office hours.
Due to a shortage of laptops in the College and as a cost-cutting exercise the College installed laptops in all lecture halls and asked the lecturers to return the laptops given to them by the College. Accordingly, Suhana returned her notebook. Due to the pandemic all Colleges have shifted to distance learning mode. Suhana was not able to conduct her online sessions as she did not have a spare laptop at home. The College terminated Suhana s contract on May 12020 with immediate effect citing poor performance. Advice Suhana on the course of action available to her.
Scenario 2:
Smiles for Miles Travels saw an advertisement in the Times of Oman regarding sale of 7 VOLVO Luxury buses. The advertisement was released by Sunfest Travels who were winding up their business in Oman. Smiles for Miles owner Musthaq responded to the advertisement. After several rounds of detailed negotiations, the deal was signed on the following terms and conditions:
Cost including interest at 6 percent per annum: OMR 250000 per bus. Total cost of seven buses: OMR1,750,000.
Cash Down Payment: OMR 150,000
No. of Instalments: 5 payables at the end of each month. The first instalment was paid on 31 January 2019.
Amount of each instalment: OMR 320,000
On receiving the cash down payment Sameer, the proprietor of Sunfest Travels completed the documentation of transferring the buses to Smiles for Miles Travels. After paying the first instalment Smiles for Miles defaulted. On being contacted they refused to pay the remaining instalments.
