Team 1- Medicare Malpractice

The Team Project includes two parts. In the first part, conduct your research on the project topic medical malpractice, following the project questions. In the second part, brief Roberts v. Williamson, 111 S.W. 3d 113 (Tex. 2003) case, analyze the situation from the risk management point of view, and prepare a root cause analysis (RCA) and an action plan.

Part 1. Explain the concepts behind medical malpractice. Is it right to say that doctors cause 69,000 deaths per year? Medical malpractice constitutes roughly only 2% of healthcare costs; why spend so much time on it? Is it less sensitive than other healthcare topics, such as rationing of healthcare resources? What is the best predictor of damages degree of negligence or the magnitude of injuries sustained? Why are arbitration clauses accepted as an alternative to medical malpractice? Having in mind that the goal of medical malpractice is to reduce medical injury and error, as tort liability increases, does negligence really fall? Can medical malpractice be considered efficient if it causes defensive medicine?

Part 2. Summarize the facts and prepare a brief of Roberts v. Williamson, 111 S.W. 3d 113 (Tex. 2003) using the IRAC method. Further, discuss the impact this healthcare negligence event had on internal and external stakeholders. Examine the legal implications related to the healthcare organization compliance, including a review of existing case law that may be applicable to this particular case scenario. Review any legal requirements associated with the case such as documenting medical error and reporting requirements. Analyze the ethical implications associated with the case. Be sure not to confuse ethical and legal implications. Discuss the problem of unavailability of the appropriate medical equipment. Locate an example of a hospital medical equipment management plan (MEMP). Discuss the scope of the MEMP program and identify the titles of those responsible for maintaining it. Use the Joint Commission Framework for Conducting a Root Cause Analysis template to prepare a root cause analysis of an adverse event in Roberts v. Williamson case. Use the organization plan of action / risk reduction strategies in the template (p.10) to prepare an action plan for managing the risk associated with this adverse event. As a result of assessing the situation and researching best practices, develop a comprehensive recommendation for the key decision makers of this healthcare organization addressing the business problems, opportunities, and a possible course of action.
