June 25, 1908 Bankruptcy: A Debtor's Perspective The Bankruptcy Code is a federal statute intended to alter the legal rights and remedies of debtors and creditors to provide a solution to the circumstances which arise when a debtor's financial affairs have reached such a state of disarray that the usual rules no longer work in an orderly and efficient manner. From the perspective of individual debtors, bankruptcy law provides freedom from lawsuits, the discharge of past due obligations and an opportunity for a fresh start. For business debtors, the Bankruptcy Code provides an opportunity for the debtor to restructure its business, create enhanced value for its creditors (and maybe its stockholders) and provides an opportunity to maintain employment that otherwise would be lost. From the perspective of creditors, bankruptcy provides an orderly and equitable distribution scheme which replaces a race to the courthouse by each creditor seeking to enforce its own rights. Further, in a reorganization, creditors can hope to benefit from the enhanced value of an ongoing enterprise, rather than accepting a pro rata share of a liquidation
