The topic that I wrote about on my paper is When Violence in Sport Leads to Civil Liability. The things that I learned while researching is how a case is made after the violent act whether it was intentional or whether the act towards the opponent was out of frustration towards your team losing or whether one player was just being reckless. In this paper, I researched some really interesting cases. That Hackbart v. Cincinnati Bengals case was interesting because in this case it involved a player that was losing striking the opponent that was winning. This case opened my eyes to how often we see this. A player injuring another player out of frustration. It is really unfortunate to see. The court sided with the Bengals saying that football was a naturally violent sport. It was then reversed and remanded for a new trial. I believe this case really helped open peoples eyes to civil liability in sport. In the Tomjanovich v. California sports case, it involved a fight during an NFL game and the player received many injuries such as a concussion, fractures in the nose, skull, and jaw, and other injuries. It was awful to hear about and an interesting thing in this case was that the player who was injured and the Lakers settled for an undisclosed amount. I was happy that they were able to settle and it was not a case of basketball being a violent game as well. Another interesting case was in Mehr v. Fderation Internationale de Football Association. In this case each of the plaintiffs had been apart of a local soccer club. What was interesting was that not all of the seven plaintiffs sued all of the defendants. The last case that I was found interesting was Green v. Pro football. This case features an alleged bounty program with an incentive for hurting players which is just insane to me that possibly happened and that players could gain from hurting someone. A big takeaway from this research paper is just how often this violence in sport happens and the legal process after another player gets injured.
