Does the Tarkanian case provide another example of a situation where some sport organizations are different from other types of business organizations?

That is, should courts consider the special nature of sport organizations and carve out an exception to the state action doctrine for collective membership organizations like the NCAA? Or should constitutional issues be treated differently than antitrust issues?
