The Canadian Real Estate Association (CREA) owns an MLS website which shows resale housing market activity. This website is governed by terms of use that prohibit commercial use of the site as well as any republishing of the data found on the site. The website states, “By downloading the property listings and data, the user confirms agreement with and acceptance of the foregoing conditions of use.” Sutton Real Estate Services broke these terms and republished the data taken from the website. Do you think that there is a contract between the CREA and Sutton? What are the arguments in favour of and against such a conclusion?
