Timothy Moher owns 440 acres of land on Sugar Island, Michigan. Sugar Island is located on the St. Mary’s River, which marks the international border between Canada and the United States. Mohr’s land is two miles from Canada. Two United States Customs and Border Protection patrol officers entered Mr. Moher’s land in order to patrol for illegal immigration activity. Mr. Moher filed suit for invasion of privacy on the grounds that the officers needed a warrant to enter his land and did not have one, nor had they obtained Mr. Mohr’s consent.
