E. I. DuPont de Nemours & Co. (DuPont) developed a new process for production of methanol. Although it had not patented the process, it had taken steps to keep the process secret. In order to implement the discovery, DuPont began construction of a refinery. During the construction process an aircraft was observed circling low above the construction site. When DuPont traced the aircraft by its numbers, they discovered that the occupants were photographers who had taken aerial pictures of the plant for an undisclosed client. DuPont believed the photographs might communicate the nature of its trade secret. Accordingly, it sued the photographers to obtain the identity of their client. DuPont then planned to sue the client for misappropriation of a trade secret. Would DuPont prevail in such a suit against the client? (DuPont v. Christopher, 621 F.2d 1012)
