Chapter Opening | Scenario Your company operates a number of pirate-themed restaurants. Historically, with rare exceptions, Caribbean pirates were male. Your cast of actors, who entertain guests during dinner, are all male. The few female employees are characterized as wenches, and they serve meals wearing suggestive costumes. The company is very profitable and seems to enjoy a high repeat customer business. Surveys undertaken by an independent consumer research firm confirm that customers have a preference for your restaurants predominately male crew and for the costuming of the female employees. Your executives know of the several cases that have been brought by the EEOC against other themed restaurants. Your management team reviews the case of EEOC v. Joes Stone Crab, Inc.1 In that case, women did not apply for the well-paid waiter positions because of the companys history of hiring only male waiters. The court concluded that the workforce statistics and the imbalance between male and female employees demonstrated that the companys reputation for hiring only male waiters could be used as evidence of discrimination. Your company has also read newspaper accounts of the $1 million settlement made by the EEOC with Lawrys, a famous prime rib restaurant chain, which had, since 1938, hired only women as waitresses. You have to make the decision whether to change your companys gender staffing policies. At present, men fill all the well-paid actor positions and attractive women compose some of the wait staff.
