Judith Samuels, a woman of the Jewish faith who observed Jewish holidays, was employed as a part-time bookkeeper at Weve Only Just Begun Wedding Chapel, Inc. (WOJB) before the owner, Charlotte Richards, discharged her. While employed at WOJB, Samuels states that Richards made her uncomfortable by conducting prayer sessions at staff meetings. Samuels also said she felt compelled to attend these services in which Richards would sing Christian songs to her both at work and over the telephone. Richards even admitted to telling Samuels, You know the Jews killed our Savior.When Samuels requested to take time off to observe Passover, she said she received a text message from Richards that read: Judy, I did not want to call you as I know this is a special time for you. However, if I allow you to take off for a special holiday, I would have to allow everyone that works here to take off for special holidays. Through this message, Samuels was terminated. Richards and WOJB defended Samuelss Title VII lawsuit on the basis of that poor work performance.The defendants moved for summary judgment claiming Samuels failed to show that the harassment or hostile work environment occurred frequently or was sufficiently severe; the defendants also claimed Samuels failed to show how the employers conduct unreasonably interfered with her work performance.1 Consider the arguments for both sides and reach a conclusion as to how the court should rule.
