In 2013, Rochelle Wynes, a registered nurse for Kaiser Permanente Hospitals, took a medical leave of absence. She was an African American woman who had complained to Kaiser management about inadequate patient treatment. She returned to work with physical restrictions, and Kaiser did not provide her with the necessary reasonable accommodations in order for her to do her job satisfactorily. This lack of action on the part of Kaiser, along with a hostile work environment, eventually led to her discharge from Kaiser. Ms. Wynes also claimed that her termination arose from Kaisers retaliation against her for being a whistleblower. She was 52 years of age at the time of her discharge. What issues would you examine regarding Ms. Wyness employment and discharge? Were any of her rights possibly violated? What arguments would you make both for and against her claim that she should have not been terminated? Can you identify the grounds upon which she may base her lawsuit for damages against Kaiser?1
