Last year, the City of Chicago received $2.33 million in JAG funding, which it used to purchase police vehicles to patrol high-crime neighborhoods.
In late July 2022, Attorney General Merrick Garland announced three new conditions on every grant provided by the JAG program.
The three new conditions require:
first, that local authorities provide federal agents advance notice of the scheduled release from state or local correctional facilities of certain individuals suspected of immigration violations;
second, that local authorities provide immigration agents with access to City detention facilities and individuals detained therein; and
third, when federal officers plan to find and arrest persons suspected of immigration violations, local authorities must provide their vehicles and, if necessary, accompany the federal officers on their immigration raids.
These conditions are nowhere mentioned in the statute creating the JAG program, nor does that statute confer upon the Attorney General any authority to attach conditions to funds disbursed through the program. May the Attorney General constitutionally demand the return of Chicago's JAG funds.
