QUESTION NO. 2 (25 marks) (i) Can you explain the sources of Hong Kong Law according to the Basic Law? (6 marks) (ii) Kate runs a store to repair computers in HK. Janice entered into a contract with Kate to repair her new computer. After making the payment of HK$5,000 by cash, she was given a receipt. On the reverse side of the receipt there was a clause: "Kate will not be responsible for any defects, problems, or personal injury caused by the repairing of the computer(s) of any client". Janice got the computer back from Kate, after Kate finished repairing it. Janice used the 2 BUS2107 Legal Aspects of Business 2020-21 Ist Term computer properly in her own apartment. After using it for 2 hours, it suddenly exploded and hurt her hands. Janice consulted a medical doctor and paid a medical fee of HK$50,000. She also paid HK$7,000 to buy a new computer from another company. After care check by relevant professional body, it has been found that Kate made big mistakes when repairing the computer of Janice, which led to the explosion of the computer. Janice claimed compensation from Kate but Kate took out the exemption clause and refused to pay any compensation. Advise Janice of her legal rights under contract law and the Sale of Goods Ordinance.
