SECTION A (40 MARKS) There are THREE (3) questions in this section. Answer all questions. Question 1 Section 20 of the Industrial Relation Act 1967 of Malaysia sets out an employee's entitlement to challenge the termination of their employment by providing that where a workman considers that he has been dismissed without just cause or excuse by his employer, he may make representations in writing to the Director General to be reinstated in his former employment. However, under certain circumstances, the court may decide that reinstatement is not possible and order the employee to be paid compensation in lieu. In this context, explain THREE (3) possible circumstances where a court may refuse to grant reinstatement. In case where reinstatement is not granted, what remedy is available to such employee? Support your answer with the relevant case laws and examples. (10 Marks)
