The issues are: 1. Did the police violate Mr. Russell's s. 8 Charter right to be free from unreasonable search and seizure when they located and seized the handgun and ammunition during a warrantless search of his pickup truck? And, 2. If Mr. Russell's s. 8 right was violated, should the evidence located during the search - which includes the hand gun and ammunition - be excluded from the evidence considered at trial pursuant to s. 24(2) of the Charter?
