Question:
There are various laws assisting creditors to collect a debt. These rights and remedies include:
- Mechanic’s Lien;
- Artisan’s Lien;
- Attachment;
- Writ of Execution; and,
- Garnishment of wages.
First, draft three (3) factual scenarios using the above-listed creditors' remedies assisting three (3) creditors to collect a debt. Assume that the debt occurred in Florida.
Second, in a separate Scenario, choose one of the Creditors from your three Scenario's and indicate how that Creditor may use another method to collect partial payment of the debt NOT involving the five (5) remedies listed above. THE OPERATIVE WORD IS NOT!!!!! For example, after writing Scenarios describing a creditor's use of Mechanic's Lien, Attachment, and Artisan's Lien, to collect a debt, take the Creditor using one of those debt collection remedies and describe another way for him or her to obtain at least partial collection of the debt.
Third, after posting the above-referenced scenarios, each student must thereafter reply to one (1) post of another student with an analysis of whether the post satisfies the requirements for this exercise and why.
