Blake worked for West Oregon Lumber Company as a wood sorter. In violation of Oregon law, the company did not carry workers’ compensation insurance. While sorting wood on a table, Blake knocked a very heavy piece off, and it fell and hit his foot. Blake sued the employer for negligence as the pieces for sorting should have been small enough to handle properly. The lumber company asserted contributory negligence as an employer’s defense.
