As the tenant of Apartment A at Starman Apartments in Homewood, you are
dissatisfied with the management's attempts to deal with disturbances from your upstairs
neighbor in D You have contacted the apartment office by phone on two separate
occasions to complain about these disturbances. On the of last month and again on
the of this month, you spoke with Sarah, the office assistant, who assured you she
would take care of the problem. Both times, she was polite but seemed distracted. The
disturbances have continued, and no one has been in touch with any kind of update.
The disturbances:
You hear hurried footsteps, jumping, and dancing every day.
You hear music, singing, laughter, and rhythmic drumming at a variety of hours.
Your neighbor owns a grandfather clock that sounds as if it is positioned right
above your bedroom. You have purchased a white noise machine to drown out the
ticking so you can sleep each night. However, the chimes that sound on every
hour and every quarter hour wake you almost every single night.
Your neighbor lives alone, but you often hear multiple voices as well as the
squeals and laughter of a small child.
You've been swooped down on by an owl multiple times on your back patio. You
have seen this owl fly into a window upstairs four times. It never flew back out
any of these times.
Last night at : AM was the final straw: A woman could be heard berating
someone else at a steadily increasing volume. When she was finished, you heard
breaking glass and other loud noises. It even sounded as if the grandfather clock
had been pushed over.
You have tried to talk to your neighbor multiple times. However, every time you try to
catch him, he slips up the stairs or out the front door and seems to vanish. You are not
sure what his name isthe label on his mailbox is smeared. Some of the other residents
say his name's David, but others say it's Jareth. No one has any idea what his last name
is They give conflicting descriptions of his appearance, yet all insist the same person has
lived there for years. They also seem confused when you mention the disturbances and
claim they haven't heard anything.
In an email addressed to Duncan Jones, the apartment manager, tactfully insist he should
personally resolve the issue as soon as possible. You should document the chronic nature
of the problem with dates, times, and specific descriptions of the disturbances with
details regarding how you are being affected. You should also list the dates when you
contacted the office to complain, identify the person you spoke to and detail the content
of your conversations. Finally, you should state your next reasonable course of action if
the problem is not immediately solved. Remember that you must follow a reasonable
course of action in order to break your rental agreement without penalty.
The Alabama LandlordTenant Law defines a livable dwelling and outlines basic rights
and duties of tenants and landlords in the state. One provision of this law is that all
tenants shall be entitled to the "peaceful enjoyment" of their residence. Remind Mr Jones
of this law to show him you are aware of what your rights are and to encourage him to
