As the tenant of Apartment 221-A at Sherrinford Apartments in Homewood, you have been less than satisfied with the management's attempts to deal with your excessively noisy neighbor. You have contacted the apartment office by phone on two separate occasions to complain about loud noises (including gunshots, explosions, shouting, and violin music) coming from your neighbor's apartment next door in 221-B. On December 15 and again on January 6, you spoke with Irene Adler, the office assistant, who assured you she would take care of the problem; however, the disturbances have continued unabated. In an email addressed to Mycroft Holmes, the apartment manager, tactfully insist he should personally resolve the issue as soon as possible. You should document the chronic nature of the problem with dates, times, and specific descriptions of the disturbances. You should also list the dates when you contacted the office to complain, identify the person to whom you spoke, and detail the content of your conversations. Finally, you should state your next reasonable course of action if the problem is not immediately solved. Remember that you must follow a reasonable course of action in order to break your rental agreement without penalty. You should be aware that the Alabama Landlord-Tenant Law, effective Jan. 1, 2007, defines a livable dwelling and outlines basic rights and duties of tenants and landlords in the state. One provision of this law is that all tenants shall be entitled to the "peaceful enjoyment of their residence.
